Walgreens v. Wegmans: The Battle for the "W"

Walgreens has launched a new battle, this time against a New York based grocery store called Wegmans. The allegation? The “W” used by the latter is confusingly similar to Walgreens.


Note the “W” on Walgreens, as compared to the one in Wegmans.

Walgreen alleges trademark protection over the style of the “W”, independent of its place within the name as such. Wegmans, who adopted the new stylized logo in 2008, argues that the “new logo” is a copy of the one they’ve been using for several decades.

Walgreen’s trademark attack on this has been on two fronts: An opposition at the TTAB and a lawsuit in the Virginia Federal Court (as to why you would file in both places, see this article at Diffbot)
