SCOTUS Will Hear Case Challenging Copyright Restoration

The Supreme Court (of the U.S.) will hear a challenge to Congress’ 1994 law, enacting the Uruguay Round Agreement Act which restored copyright to works previously in the public domain. Specifically, the certiorari petition asks:

  1. Whether the “Progress Clause” of the US Constitution prohibits Congress from removing works from the public domain?
  2. Whether the removal of those works from the public domain violates the First Amendment of the United States Constitution?
