Trade Secrets Bill Approved by Puerto Rico Legislature (Updated)

On May 23, 2011, the Puerto Rico Senate approved the amendments made by the lower chamber on P. de la S. 1850, also known as the Puerto Rico Trade Secrets Act (Ley de Secretos Comerciales). The bill, as approved, will allow for a three (3) year statute of limitations. As originally drafted, the bill allowed for one (1) year since the owner of the trade secret knew (or should have known) of the violation.

The bill will now pass to the Governor and become Puerto Rico’s first (and only) trade secret legislation.
