Patent Infringement in the Tropics: EON Corp Sues AT&T Puerto Rico

It’s not every day a U.S. President visits the island of Puerto Rico, just like it’s not everyday that there is a patent infringement claim in the District Court of Puerto Rico. But lo and behold, this week we had both! This week, patent holding company EON Corp. IP Holdings, LLC filed a patent infringement claim against: AT&T Mobility, Puerto Rico Telephone Company, Claro and other telecoms on the island. EON claims to own a series of patents over wireless modems (such as AT&T Wifi on the Spot) and interactive television for mobile phones (such as ATT Mobile TV).

According to a document found on Scribd, this is not the first suit Eon files for the patents mentioned in the complaint. There seems to be a complaint filed in the Eastern District of Texas against T-Mobile for the same patents. There also seems to be some lack of love from the ED of Texas, by a certain Judge Love (not joking), ruling against Eon on a similar patent suit regarding a discovery motion. As to the merits of that case, we haven’t been able to look into it.

The case is being handled by a local firm, Ferraiuoli, known for its patent law expertise, together with outside counsel appearing pro hac vice from Reed & Scardino LLP.  It was filed this week, so an answer to the complaint is a long way coming. We will follow this case closely and report back when we have more documents.
